ReadCam Terms of Use

These Terms govern your use of the ReadCam Android application provided by Primitive Recordings LLC. By using ReadCam, you agree to these Terms. If you do not agree, do not use the app.

License

Primitive Recordings LLC grants you a limited, non-exclusive, non-transferable, revocable license to use ReadCam for lawful personal or business recording purposes, subject to these Terms. ReadCam is licensed, not sold.

Your scripts and recordings

You retain responsibility for the scripts and recordings you create with ReadCam. You must have all rights, permissions, releases, and consents required for the words, music, images, people, locations, trademarks, and other material you record. You are responsible for complying with privacy, publicity, copyright, recording-consent, employment, and other applicable laws.

ReadCam does not review, moderate, upload, or store your scripts or recordings on Primitive Recordings LLC servers.

Storage and backups

ReadCam stores scripts and settings locally and saves recordings as device media. You are responsible for maintaining device storage, protecting your device, and backing up recordings you wish to keep. Removing the app, clearing storage, changing devices, device failure, or actions by other apps or system services may affect locally stored material.

Acceptable use

You may not use ReadCam to violate law, infringe another person’s rights, secretly record where consent is required, distribute malware, interfere with the app or its security, or misrepresent your affiliation with Primitive Recordings LLC.

Ownership

ReadCam, its software, name, design, branding, and included assets are owned by Primitive Recordings LLC or its licensors and are protected by applicable intellectual-property laws. These Terms do not transfer ownership of ReadCam to you.

Device compatibility and availability

Camera, microphone, encoder, storage, and playback behavior can vary by device, Android version, manufacturer, available space, and other software. We may change, update, suspend, or discontinue ReadCam or particular features. We do not guarantee compatibility with every device or uninterrupted availability.

Disclaimer of warranties

To the maximum extent permitted by law, ReadCam is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. Some jurisdictions do not allow certain exclusions, so some of these terms may not apply to you.

Limitation of liability

To the maximum extent permitted by law, Primitive Recordings LLC and its members, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of recordings, scripts, data, revenue, profits, goodwill, or business opportunity arising from ReadCam. Any aggregate liability will not exceed the amount you paid for ReadCam during the twelve months before the claim. Rights that cannot legally be limited remain unaffected.

Termination

These Terms remain effective while you use ReadCam. Your license ends if you materially violate them. Provisions that by their nature should survive termination will survive.

Governing law

These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles. Any action arising out of or relating to these Terms or ReadCam must be brought in a court of competent jurisdiction located in Clark County, Nevada, including an applicable Nevada state court or federal court. You and Primitive Recordings LLC consent to the personal jurisdiction and venue of those courts.

Changes and contact

We may update these Terms as ReadCam changes. The published Terms will show their effective date. Use the support form and we’ll reply by email.
